Construction Work Injuries in Delaware County: Records That Can Help Your Claim

Construction sites often involve several employers, changing work areas, and equipment supplied by different companies. After an injury, those details can be hard to reconstruct. A clear account of the task, the people involved, and the documents received can help an attorney evaluate what should happen next.

Start with medical care and a clear report

Obtain appropriate medical attention and tell the provider how the injury occurred. Notify your employer promptly. Save the incident report, discharge instructions, work restrictions, and correspondence from the employer or insurer. Do not delay reporting while trying to decide who caused the accident.

Identify who hired, paid, and directed you

Write down the name of the company that hired you, the name on your pay statement, who assigned the work, and who supervised the site. If a subcontractor was involved, include that company’s name too. Keep contracts, pay records, and any paperwork describing you as an independent contractor.

A label on a contract or tax form does not settle every classification question. Pennsylvania has specific rules concerning independent contractors in construction, and the full working relationship matters. Ask an attorney to review the arrangement instead of assuming that a “1099” designation rules out a claim.

Preserve useful information without entering an unsafe area

If you already have photographs, messages, or equipment information, keep the originals. Make a list of witnesses and the companies they worked for. Note whether scaffolding, a ladder, a vehicle, a tool, or another piece of equipment was involved, including identifying details you know.

Do not return to a restricted or unsafe site to collect evidence. Do not alter equipment or remove another company’s property. Tell the attorney what information may exist so appropriate preservation requests can be considered.

Separate the injury from the benefits paperwork

Make a short timeline with these dates: the incident or first symptoms, notice to the employer, medical visits, missed work, any return-to-work offer, and each notice received. Keep the notices in date order.

A covered workers’ compensation claim may involve medical expenses, wage-loss benefits, or other benefits depending on the injury and applicable requirements. Avoid estimating an award from a coworker’s case: different injuries, earnings, and legal circumstances can produce different results.

Ask whether another legal claim needs investigation

Workers’ compensation and a possible claim against another responsible party are different questions. On a multi-company site, an attorney may need to examine contractual relationships, responsibility for equipment, and any applicable immunity before deciding whether a separate claim is available. The presence of a general contractor or another company does not by itself establish liability.

Bring a focused file to your consultation

Include the incident report, medical restrictions, recent pay records, employer and insurer letters, relevant contracts, and available witness details. If you received a denial or a notice changing benefits, bring the complete document and its envelope if available. Explain what you need help with now — treatment, missed income, a work assignment, or disputed paperwork — so the discussion can focus on the immediate issue.

I had an excellent experience with Mrs. Deborah during my custody case. I was handling my case from another state, so everything was done virtually, and she made the process seamless. I was always able to contact her, and her communication was clear, timely, and consistent. She was professional, knowledgeable, and ensured I understood every step while keeping me prepared. Even in stressful situations, she remained confident and detail-oriented, and she strongly advocated for me throughout the case. Most importantly, the outcome I was seeking was achieved, which speaks to her effectiveness and dedication. I highly recommend her to anyone looking for a reliable and results-driven attorney.
