Denied Workers’ Compensation

Our Contingency Fee Policy For Injury Cases

We have a contingency fee agreement with all of our Workers’ Compensation and Personal Injury clients. Our fee is based on a percentage of what we obtain for you, and we will not charge you any fee unless and until we settle your case, prevent the loss of your benefits or obtain benefits for you.

Was Your Workers’ Compensation Claim Denied?

Simply reporting your workplace injury is not always enough to get the compensation you need. The complexity of the Workers’ Compensation insurance claims process is far greater than most people realize, particularly when they have never been through it before.

Do not let one undervalued, delayed or denied claim cause you to throw in the towel. If you have been injured at work, you deserve to receive the benefits that are provided to you through the Pennsylvania Workers’ Compensation Act.

Deborah M. Truscello, founding attorney of the Law Office Of Deborah M. Truscello, has represented injured workers throughout Delaware County and Pennsylvania for more than 25 years. She leads our firm with a focus on what matters most: our clients, their health and their road to recovery.

My Workers’ Compensation Benefits Were Denied. What’s Next?

Half of the battle in obtaining the medical treatment and financial assistance you need after an on-the-job injury involves illustrating the severity of your injury to your employers’ Workers’ Comp insurance carrier. Insufficient information often results in insufficient or denied settlements.

The first step to appealing an unfavorable decision involves communicating with your employer and the insurance carrier that has denied your benefits. With help from an experienced attorney you can request the claim be reviewed again with more information through administrative processes within the insurance company.

If this does not work, you will need to file a petition with the Office of Adjudication, which resolves disputes through the use of Workers’ Compensation (WC) judges in a hearing. Furthermore, if the WC judge’s decision is unfavorable, it can be appealed through the Workers’ Compensation Appeal Board and, if necessary, the Commonwealth Court.
